- Unearthodox maintains this website (the “Site”) as a service to those who may choose to access the Site (“Users”).
- Unearthodox grants permission to Users to visit the Site and to download and copy the information, documents and materials (collectively, “Materials”) from the Site for non-commercial uses, without any right to resell or redistribute Materials or to compile or create derivative works from them, subject to the terms and conditions outlined below, and also subject to more specific restrictions that may apply to specific Materials within this Site. Users are responsible for checking that their use of any Materials downloaded from the site does not infringe any copyrights owned by third parties.
- No waiver by Unearthodox of any provision of these Terms and Conditions shall be binding except as set forth in writing and signed by the Director of the Institute and its duly authorised representative.
- Unearthodox reserves its exclusive right in its sole discretion to alter, limit or discontinue the Site or any Materials in any respect.
Our guarantees
- The collaborative arrangements that Unearthodox makes with national, regional and international partners in the pursuit of its Mission will be transparent, fair and equitable, and these qualities will be demonstrated when our partners are represented on our website.
- Unearthodox will take stringent measures to ensure that contributors of information shall be correctly attributed and the integrity of their contributions preserved. We will not inappropriately assert any intellectual property rights in the information generated by our partners. Furthermore, wherever possible we will record the ‘ownership’ and Intellectual Property Rights associated with the work that we undertake and we will ensure the necessary permissions are in place for its use. Where ownership and Intellectual Property Rights are unclear we will make fair and equitable arrangements to facilitate the deployment of information to the benefit of conservation.
Disclaimers
- Any reference on the Site to a commercial entity or product does not imply any endorsement by Unearthodox.
- Under no circumstances shall Unearthodox be liable for any loss, damage, liability or expense incurred or suffered that Users claim to have resulted from the use of this Site, including, without limitation, any fault, error, omission, interruption or delay with respect thereto.
- This Site may contain links and references to third-party web sites. These linked sites are not under the control of Unearthodox and Unearthodox is not responsible for, and does not endorse any of their content.
Take-down policy
- Unearthodox operates a ‘take-down’ policy such that if we are notified of a potential breach of copyright, or other reasonable notice of a possible violation of any law (including but not limited to laws on copyright, patent, intellectual property, trademark, confidentiality, data protection, obscenity, terrorism, defamation or libel), the complete document or dataset or relevant portion will be removed from the repository as quickly as possible pending further investigation. Where the grounds for complaint are proven to be valid, the complete document or dataset or relevant portion will be permanently withdrawn from the repository. A decision on whether the material may be made available again may take some time if it is necessary for Unearthodox to seek legal advice to resolve the complaint.
How to Notify Unearthodox of a Take-Down Request:
- If you have discovered material on our Site or in our electronic document collection which you consider to be unlawful, for example you consider that it breaches copyright, either yours or that of a third party or any other law, including but not limited to those relating to patent, trademark, confidentiality, data protection, obscenity, defamation, libel or incitement to terrorism, please email the Director providing the following information:
- Your contact details
- The details of the material including URL where possible
- The nature of your complaint or concern
- An assertion that your complaint is made in good faith and is accurate
- If you are complaining about breach of your own copyright or other intellectual property right, please also confirm that you are the rights owner or are authorised to act for the rights owner.
- The following Procedure will then be invoked:
- Unearthodox will acknowledge receipt of your complaint by email or letter and will make an initial assessment of the validity and plausibility of the complaint, possibly taking legal advice.
- If the initial assessment is that the complaint is potentially valid and/or requiring further consideration or legal advice, the material will be removed from the website pending an agreed solution.
- Where relevant, the original contributor of the material in question will be notified that the material is subject to a complaint, what the basis of the complaint is, and will be encouraged to respond to, or address the complaints concerned.
- On completion of the take-down procedure outlined above, one of three outcomes will result:
- If the complaint is proven to be invalid, the dataset or relevant portion will not be changed and the dataset will be reinstated on the website.
- If the complaint is valid and an agreed-upon solution results in changes/updates to the material in question, the material will be reinstated on the website after the necessary changes/updates have been made.
- If the complaint is valid and an agreed-upon solution cannot be reached, the material will be permanently removed from the website.
- In each case, you will be informed of the decision. If you are unhappy with the decision taken, please email us at info@unearthodox.org
